Terms and Conditions for SightScape’s App and Website

Welcome to SightScape. The following terms and conditions govern your use of the SightScape website, mobile application, and any related services (collectively, the 'Platform'). By accessing or using our Platform, you agree to these terms and conditions in full.

For the purposes of these Terms and Conditions, the following terms are defined as follows:

  1. ‘Platform’ refers to the SightScape website, mobile application, and any related services provided by us.
  2. ‘User’, ‘You’, and ‘Your’ refer to the individual, company, or organization that has visited or is using the Platform and/or any of the services provided by SightScape.
  3. ‘Content’ encompasses all text, information, graphics, audio, video, and data offered through our Platform, whether provided by us or by users and third parties.
  4. ‘Passes’ are digital tickets or vouchers that provide users access to attractions and services available through the Platform.
  5. ‘Services’ refers to all services provided by SightScape, including but not limited to access to attractions, customer support, and the provision of information and Content through the Platform.
  6. ‘Terms’ or ‘Terms and Conditions’ mean these terms and conditions that form a legally binding agreement between you and SightScape for the use of the Platform.
  7. ‘Third-party partners’ include all advertisers, analytics providers, content providers, service providers, authorized resellers, or any other external business entities that SightScape may collaborate with.
  8. ‘Personal Information’ means any information that can be used to identify you, as defined by applicable data protection laws.

Integration with Privacy Policy

By agreeing to these Terms and Conditions, you also acknowledge and consent to the practices outlined in our Privacy Policy, available at https://sightscape.com/en/privacy-policy. This policy details how we collect, use, and protect your personal information.

Account and User Information

  1. SightScape reserves the right to change your username, password, and other account details.
  2. We may ask for extra information or documentation when necessary.
  3. Your account may be terminated, suspended, restricted, or blocked based on our discretion. Grounds for account termination may include, but are not limited to Violation of these Terms and Conditions.
    • Engaging in illegal activities or fraudulent behavior.
    • Misuse or fraudulent use of our passes, such as sharing passes with non-authorized users, attempting to duplicate passes, or using passes for unauthorized purposes.
    • Creation of multiple accounts to avoid suspension or bans.
    • Any other actions deemed harmful to the platform or its users.
  4. You are responsible for ensuring that the information provided in your account is accurate and current. It's necessary to promptly update any changes. SightScape cannot be held liable for issues arising from inaccurate or outdated account details.
  5. The use of passes is solely under the name on the ticket. However, name changes or transfers are permissible before activation.
  6. Using a single pass for multiple individuals is fraudulent and may lead to legal consequences. Users agree to compensate SightScape for any costs incurred due to misuse, including payments to attractions, legal fees, and recovery costs.

Data Consent

In registering an account, you consent to the collection and use of your personal information as described in our Privacy Policy. This includes, but is not limited to, your name, age, email, device data, phone number, gender, and usage details.

Data Usage and Third-party Sharing

  1. SightScape reserves the right to share certain user information, including but not limited to name, age, email, engagement details, device data, IP addresses, browsing history, and cookies, with third-party partners.
  2. We may share user data with advertising partners, analytics providers, attraction partners, and third-party service providers who assist us in operating the Platform.
  3. Data sharing with third parties may be for purposes such as targeted advertising, analyzing platform usage, improving our services, and enhancing user experience.
  4. We encourage users to review the privacy policies of any third-party platforms we may share data with to understand how their data may be used.
  5. We may monitor and track user behavior and app usage for optimization purposes.
  6. To request the deletion of your personal information or to deactivate your account, kindly reach out to our customer support team from Contact Us page on our website.

SightScape uses cookies and other tracking technologies to enhance user experience and analyze platform usage. By using our Platform, you agree to the use of these technologies.

Content, Intellectual Property, and Restrictions

  1. All content, including text, graphics, logos, and interactive features, are owned by SightScape or licensed to us. Unauthorized reproduction, modification, or distribution violates intellectual property rights.
  2. Users may not avoid, disable, or interfere with security features or any features that prevent unauthorized use or copying of content.

User-Contributed Content

  • When users contribute content like feedback, comments, reviews, or ratings, SightScape reserves the right to use this material in any way deemed fit.
  • By submitting such content, users grant SightScape a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, and display their contributions on our platform.
  • Users must own or have the right to use the intellectual property in the content they post, ensuring it doesn’t infringe on intellectual property or third-party rights.
  • Users are responsible for any claims that may arise due to intellectual property or third-party rights violations in their content.
  • SightScape reserves the right to remove or modify any user content that is considered inappropriate or unlawful, at our sole discretion.
  • SightScape is not obligated to use, display, or publish any user content.
  • Links to Third-Party Websites

    Our Platform may contain links to third-party websites. SightScape is not responsible for the content, privacy policies, or practices of any third-party websites.

    Content

    1. Content displayed on our Platform, including attraction details, may not always reflect the most recent information and can be subject to change without prior notice.
    2. While we strive for accuracy in our website, app, and attraction information, we cannot guarantee it will always be up-to-date. We are not liable for any loss due to reliance on this information.
    3. SightScape cannot guarantee the availability of attractions. Attractions may be added or removed, and users are advised to check for daily updates.

    Platform Usage Limitations

    1. Tickets can only be accessed through the app due to security reasons. Logging out and logging back in after activating the All-Inclusive Pass is not permitted.
    2. The use of our platform in acts that harm the platform are considered a prohibited and forbidden act, and the person responsible will be legally prosecuted, whether this harm is verbal or practical.
    3. Reselling passes is prohibited unless authorized as an official reseller by SightScape.

    Access to our Platform

    1. Access to our platform is temporary and subject to change without notice. Access may be restricted at any time.
    2. SightScape does not guarantee uninterrupted or error-free access to our platform. Compatibility with all hardware and software is not guaranteed.
    3. Users are responsible for accessing our platform and ensuring others using their internet connection comply with these terms.
    4. We may update, suspend, or discontinue any part of our platform at any time. Material on our platform may be outdated and we are not obligated to update it. We reserve the right to modify terms related to the platform at any time.

    Age Restrictions

    1. The Services provided by SightScape are designed for users who are at least 18 years of age. Users under the age of 18 are prohibited from accessing and using the Services. By utilizing the Services, you affirm that you are at least 18 years old.
    2. By accessing and using the Services, you are asserting that you are over the age of 18 and possess the legal capability to accept and adhere to these Terms. Furthermore, you confirm that you have the requisite authority and capacity to abide by this agreement in its entirety.

    Pass Specific Terms and Conditions

    1. The All Inclusive Pass: The Pass becomes active from the first time you use it. After activation, it can be used for the consecutive number of days you have paid for, starting from the first day of use, regardless of the time of day.
    2. Adventure Pass: From the date of purchase, you get 90 days to visit the total number of attractions included in your pass. If the attractions are not visited within this 90-day period, the pass will no longer be valid.

    Bookings or Reservations

    1. Bookings or reservations made through third parties are considered a definitive agreement to visit the attraction at the specified date and time. Any proof of booking or reservation held by the attraction is deemed valid.
    2. Bookings or reservations with attractions are strictly non-cancellable, unless the attraction specifies otherwise. For cancellation inquiries, contact the attraction directly.
    3. In the event of a no-show (when a person does not arrive for their booking or reservation on time), SightScape reserves the right to:
      • Lock: Restrict the use of the pass for a certain duration of time.
      • Activate: Commence the usage period of the pass.
      • Count a No-Show: Record the incident as a no-show against your pass’s attraction choices.
    4. These actions are taken to ensure fair usage and availability of attractions for all guests. For details on no-show policies or potential accommodations, please contact the individual attraction.

    5. In cases where a guest is late for a booking or reservation, it is at the discretion of the attraction to determine whether this constitutes a no-show or if the guest is allowed to use the attraction. SightScape is not responsible for decisions made by the attraction in such instances and advises guests to contact the attraction directly for any potential leniency or accommodation regarding late arrivals.

    Pass Validity and Usage

    1. Passes are secured using state-of-the-art security algorithms and require logging into the SightScape app using Android or Apple devices and are not accessible through the website.
    2. Passes are valid for 90 days from the purchase date.
    3. Attractions cannot be repeated within the same pass.
    4. For security purposes upon each scan of the pass, the pass will be automatically deactivated. This deactivation will last for either one hour or the entire duration of the activity, attraction, or experience if the duration is listed, whichever is longer. During this deactivation period, the pass cannot be scanned or used.
    5. The user acknowledges and agrees that, upon sending or transferring the pass and it’s acceptance by the recipient, the pass will be irreversibly removed from the user’s account. The user willingly forfeits all rights and privileges associated with the pass. This action is final and can not be undone.

    Fee and Payment Information

    By providing a payment method, you represent that you are authorized to use the payment method provided.

    Refund Policy

    1. Refunds are available within 30 days of purchase provided the pass remains unused. All refund requests should be directed to our customer support team by filling the form on our Contact Us page. Please note that bank fees or exchange rate variations during the refund process are not covered by SightScape. There is also a 5% fee deductible from the total price of your pass for Tamara Installment services.
    2. Refunds for authorized reseller purchases are determined by both SightScape and the reseller and they do not abide by our refund policy.
    3. Upon transferring or sending the pass, users forfeit their right to a refund, regardless of circumstances.

    Pricing Changes

    SightScape reserves the right to change the pricing for its services at any time. We will provide notice of any such pricing changes by posting the new prices on our Platform or through email notification.

    Location and Tracking

    SightScape may track the location of pass users for service optimization and user experience enhancement.

    Attraction Participation and Availability

    1. SightScape acts as a third-party gateway to attractions and is not responsible for any dissatisfaction or injury during attraction visits.
    2. Users must adhere to individual attraction terms, conditions, and safety guidelines.
    3. Complaints regarding attractions should be addressed directly with the respective attraction.
    4. SightScape does not guarantee attraction capacities or booking availabilities.

    SightScape’s Liabilities

    1. SightScape is not liable for external factors such as weather or unforeseen circumstances affecting the use of passes or attractions.
    2. We are not responsible for any inappropriate information or illegal activity in external links provided on our Platform.

    AI WhatsApp Support

    Our WhatsApp support chat is powered by Artificial Intelligence (AI). While we strive to provide accurate and relevant information, not all responses may be applicable or correct. SightScape is not liable for any compensation or damages arising from reliance on information provided by this AI-powered support service. We encourage users to verify critical information through our terms and conditions, privacy policy, or through email.

    Indemnification

    Users agree to indemnify and hold harmless SightScape, its affiliates, officers, directors, and employees from any claims, damages, liabilities, and expenses arising out of their use of the Platform and violation of these Terms and Conditions

    Jurisdiction and Governing Law

    These Terms and Conditions shall be governed by the laws of Saudi Arabia. Any disputes arising out of or relating to these Terms and Conditions or the use of the Platform shall be resolved in the courts of Saudi Arabia, Jeddah.

    Dispute Resolution

    Any disputes arising out of or in relation to the Platform will first attempt to be resolved through cooperative negotiations. If such negotiations are unsuccessful, parties agree to resolve disputes through the courts of Saudi Arabia, Jeddah.

    Severability

    If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.

    Waiver

    The failure of SightScape to enforce any right or provision of these Terms and Conditions will not constitute a waiver of such right or provision.

    SightScape maintains the right to periodically update our terms and conditions without explicit notification to users. Continual usage of our platform implies user acknowledgment and adherence to our most current terms and conditions. It is implied that users have reviewed and are aware of the most recent version of our terms and conditions.

    Users can access the most current version of these Terms and Conditions on our Platform at any time. We encourage users to review these Terms and Conditions regularly to stay informed.
